Public Pool and Spa Enforcement Documents
The Public Pool and Spa Program was established to help ensure public health and safety when using public facilities such as pools and spas. To implement
this program, DES adopted administrative rules Env-Wq 1100 to specify the design, operation, and maintenance requirements for public pools and spas. The
inspection program was developed to determine if public health and safety is being put at risk in public aquatic venues. The inspection process identifies
what components of facility operation are going well, and those that require attention. In cases where there are significant safety and/or water quality
violations, enforcement action may be necessary and a Letter of Deficiency (LOD) issued to the facility’s owner. An LOD is a legal enforcement document
that articulates the inspection findings, and outlines what action is required to come into and maintain compliance.
The following is a list of all LODs since the inception of the inspection program.
